PT Blue Bird Tbk (BIRD) delivered an explanation regarding the lawsuit filed by Elliana Wibowo which was submitted to the South Jakarta Court. Blue Bird, being one of the defendants, said that Elliana Wibowo was not a shareholder.

"Based on the Shareholder Data of PT Blue Bird Tbk from the Company's Securities Administration Bureau, the Plaintiff is not registered as a shareholder of the Company," said the statement letter submitted by Blue Bird's management, Tuesday (2/8/2022).

As a public company, the letter stated, Blue Bird has complied with capital market regulations and provisions, including the provisions for dividend distribution in accordance with the provisions of the Indonesia Stock Exchange (IDX) and the Financial Services Authority (OJK) and ensured that all registered shareholders receive their rights including dividends in accordance with number of shares. 


In the letter, Blue Bird's management also said that they will continue to focus on business and financial development plans so that management believes that this will not affect the company's financial and operational performance in line with the company's performance which continues to show a positive trend in the first semester of 2022.

Blue Bird stated that it would implement good corporate governance, we respect the applicable regulations and policies in carrying out the Company's business activities and are committed to complying with all applicable procedures and regulations.

"We will provide further responses based on a thorough review of the above-mentioned issues upon receipt of the lawsuit in question," the letter said. 

As has been widely reported, Blue Bird Group and a number of parties such as the Metro Jaya Police Chief Inspector General Fadil Imran to former National Police Chief Bambang Hendarso Danuri were sued to the South Jakarta District Court (PN) by one of its shareholders, Elliana Wibowo. Unmitigated, the value of the lawsuit filed reached more than Rp. 11 trillion.

Reported from the South Jakarta District Court website, Monday (1/8/2022), the lawsuit was registered on Monday 25 July 2022 with case number 677/Pdt.G/2022/PN JKT.SEL. Elliana sent Davy Helkiah Radjawane as her attorney.

The lawsuit was filed regarding changes to Blue Bird's AD/ART, Elliana's shares in PT Blue Bird Taxi, PT Big Bird, and PT Blue Bird Tbk, as well as shares of one of the shareholders in PT Blue Bird Tbk.

In the lawsuit file quoted on Monday (1/8), Elliana gave several reasons for bringing the stock issue to court. For Fadil Imran and Bambang Hendarso Danuri, for example, he submitted the lawsuit because he accused the two people of having committed legal acts that hindered his sense of justice as a society.

For Blue Bird Taxi and Big Bird, he filed a lawsuit because the two parties had obstructed his rights as shareholders of the company. 

On that matter, Elliana asked the court for several things. First, stating that Blue Bird Taxi and Big Bird have committed an unlawful act to obstruct their rights as shareholders.

Second, stated that Fadil Imran, represented by Bambang Hendarso Danuri, had committed an unlawful act that hindered justice for him.

Third, to declare that the confiscation of shares owned by Defendant I is valid and valuable in Blue Bird amounting to 284,654,300 (two hundred eighty four thousand six hundred fifty four thousand three hundred) shares and a house located on Jl. Brawijaya No. 46, Kebayoran Baru Baru, South Jakarta and Jl KemangTimur Raya Number 34.

Sentenced defendants VII, VIII, and IX (Blue Bird Taxi, Big Bird, and Blue Bird) jointly and severally to pay compensation in the amount of Rp. 1.363 trillion (One trillion three hundred sixty three billion seven hundred sixty eight million nine hundred thousand rupiah) with details, namely the payment of dividends in the amount of Rp. 1,234 trillion (One trillion two hundred thirty-four billion one hundred and eighty million rupiahs) plus an interest of 10 percent per year for 10 years and six months in the amount of Rp. 129.588 billion (one hundred and twenty nine billion five hundred and eighty eight million rupiah)," he said.

"Punished ACCUSED I to ACCUSED IX (Bambang Hendarso Danuri, Fadil Imran, Blue Bird, Big Bird, Blue Bird Taxi, Cs) to pay jointly and severally for immaterial losses of Rp. 10 trillion (Ten Trillion Rupiah)," he added.

Elliana also asked the court to declare that this decision is immediate and can be executed first even though there is an appeal or cassation.
